Terms & Conditions

The rules that govern access to and use of Top Prime Media services.

This document is designed as a clear operational policy. It should be reviewed periodically against changes in Kenyan law and the company’s actual practices.

Agreement to these terms

These Terms & Conditions form a binding agreement between you and Top Prime Media when you access or use our websites, applications, live players, newsletters, accounts, competitions, events and related services. If you do not agree, do not use the services. Additional written terms may apply to subscriptions, events, promotions, advertising or content licences.

1. Eligibility and accounts

You must have legal capacity to agree to these terms. A person under 18 should use interactive or commercial services only with a parent or guardian. You must provide accurate information, protect credentials and promptly report suspected unauthorised access. You are responsible for activity through your account unless caused by our failure to use reasonable security.

2. Licence to use the service

TPM grants you a limited, revocable, non-exclusive, non-transferable licence to access the services for lawful personal or internal business reading. This does not transfer ownership. Access may be subject to technical, geographic, account, age or subscription restrictions.

3. Acceptable use

You must not:

  • break any law, impersonate another person, harass, threaten, defame, exploit or endanger anyone;
  • introduce malware, probe security, bypass access controls, interfere with availability or use automated traffic that burdens the service;
  • scrape, reproduce, train a model on, republish, syndicate or commercially exploit substantial TPM content without written permission;
  • remove attribution, copyright, watermark or rights-management information;
  • submit unlawful, infringing, hateful, deceptive, pornographic, confidential or privacy-invasive material;
  • manipulate polls, metrics, comments, advertising delivery, contests or recommendation systems.

4. News is not professional advice

News and commentary are for general information. They are not legal, medical, financial, investment, tax or other professional advice. Markets, public policy and developing stories can change quickly. Verify important information and obtain qualified advice before acting. Opinions belong to identified authors and do not necessarily represent TPM.

5. Accuracy, corrections and archives

We work to publish accurate information but cannot warrant that every item is complete, current or error-free. Developing coverage may change. We may correct, clarify, update, label, restrict or remove material according to our Corrections Policy. Archives are a historical record and may retain original context alongside later updates.

6. User submissions

You keep ownership of original material you submit. You grant TPM a worldwide, non-exclusive, royalty-free licence to host, reproduce, edit for length and safety, translate, distribute, display and promote that submission in connection with TPM services, unless a written confidential-source arrangement says otherwise. You confirm that you have the necessary rights and that the material is lawful. Do not send confidential or dangerous material through ordinary channels.

7. Comments and moderation

We may pre-moderate, post-moderate, label, close or remove comments and suspend accounts to protect users, editorial integrity and lawful operation. Moderation is discretionary and does not mean TPM endorses user content. Report harmful content to moderation@topprimemedia.co.ke.

8. Third-party links, embeds and streams

Links and players may be supplied by broadcasters, platforms or other third parties. Their terms, privacy practices, availability, rights and geographic restrictions apply. A listing or embed is not an endorsement or transfer of ownership. We may replace or remove a source at the rights holder’s request or when availability or legality changes.

9. Advertising and transactions

Advertising is identified and governed by our Advertising Policy. Advertisers are responsible for claims, offers, products and landing pages. Any purchase from a third party is between you and that provider. TPM is not the seller unless a checkout expressly identifies TPM as merchant.

10. Intellectual property

The services, TPM name, logos, software, page design, databases and TPM-created journalism are protected by applicable intellectual-property law. Limited quotation may be permitted by law when fair, proportionate and attributed; it does not authorise systematic copying. See Copyright & Permissions.

11. Service changes and availability

We may maintain, improve, suspend or discontinue features; change free or paid availability; and apply reasonable limits. Live services may be interrupted by network, rights, platform or security issues. We will aim to give reasonable notice of material paid-service changes where practicable.

12. Disclaimer of warranties

To the maximum extent permitted by law, services are provided “as available”. We do not promise uninterrupted access, specific audience results, compatibility with every device or that third-party content is error-free. Nothing excludes warranties or consumer rights that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, TPM is not liable for indirect, incidental, special or consequential loss, lost opportunity, loss of profit, loss of data or reliance on general news content. Where liability cannot be excluded, it is limited to the amount paid by you for the affected service during the preceding twelve months, except where law requires a different remedy. Nothing limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or another liability that law forbids us to limit.

14. Indemnity

You will be responsible for reasonable loss, claims and costs arising from your unlawful use, material you submit, or breach of these terms, to the extent permitted by law and attributable to your conduct. TPM will give reasonable notice and control of a covered defence where appropriate.

15. Suspension and termination

We may restrict or terminate access for material or repeated breach, legal requirement, fraud, security risk or harm to others. We will act proportionately and provide notice where lawful and practicable. Provisions concerning rights, liability, disputes and accrued obligations survive termination.

16. Governing law and disputes

These terms are governed by the laws of Kenya. First send a written dispute notice to legal@topprimemedia.co.ke and allow 30 days for good-faith resolution. If unresolved, Kenyan courts have jurisdiction, without preventing either party from seeking urgent protective relief or using a regulator or tribunal that has lawful authority.

17. General

If a term is unenforceable, it will be adjusted or removed only to the minimum extent necessary; the rest remains effective. Delay in enforcement is not waiver. You may not transfer this agreement without consent; TPM may transfer it as part of a genuine reorganisation with continued protection of your rights. The English version controls where a translation differs.
